When you submit a check-in, your browser asks for your location permission. We use this to place your experience dot on the map and derive city, state, and zip code from those coordinates. We do not continuously track your location in the background. If you deny location access, you cannot submit a check-in.
Mood Swing may use aggregate, anonymized, or de-identified information for marketing, sales, business development, product demos, commercial reports, datasets, and advertising about Mood Swing. These materials may include demographic segments or trends, such as age range, gender, vibe, sentiment, place, city, state, time, or event context, but they are not intended to identify you personally.
When we describe information as aggregate, anonymized, or de-identified, we mean information that is not intended to be reasonably linkable to a specific person, household, account, browser session, or device. We take reasonable steps to maintain that information in aggregate, anonymized, or de-identified form and not to re-identify it, except to test whether our privacy protections work.
Mood Swing may use, disclose, sell, or share personal information for marketing, targeted advertising, cross-context behavioral advertising, advertising measurement, audience enrichment, data partnerships, and related commercial purposes. Depending on the advertising tools we use, this may include email address or hashed email address, account identifiers, session identifiers, device or browser identifiers, IP address, location information, demographic information, check-in context, vibe and sentiment selections, place or event context, and inferences derived from that information.
Some privacy laws may treat these activities as a sale or sharing of personal information or as targeted advertising. Where required by law, we will provide opt-out rights or other privacy choices and honor applicable privacy requests. We will not use your name, email, likeness, or account identity to imply your personal endorsement in public marketing without your permission.
You can use Privacy Choices to opt out of the sale or sharing of your personal information for targeted advertising. You do not need an account to make this choice. We store the choice with your account if you are signed in, or with your anonymous browser session if you are not signed in. We use information collected for privacy choices only to honor those choices.
If your browser sends a Global Privacy Control signal, we treat it as a request to opt out of sale or sharing for that browser or session.
Your experience dots appear on the map but are not linked to your name or identity. Other users can see the vibe, sentiment, and general location of submissions, but cannot identify who submitted them.
You can submit check-ins without an account. These submissions are saved with an anonymous session ID. If you later sign in, your previous anonymous submissions are linked to your account. Signed-in users can view their check-in history on their profile.
We use a session cookie to manage your sign-in state and submission limits. We store a small amount of data in your browser's local storage for rate limit countdowns and UI preferences. If we enable advertising, analytics, or measurement tools, they may use cookies, pixels, local storage, or similar technologies to recognize your browser or device, personalize ads, enrich advertising targeting, measure campaigns, and understand how the service is used.
If Mood Swing is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, personal information may be disclosed, sold, assigned, or transferred as part of that transaction. Any recipient must use the information consistently with this Privacy Policy unless users receive notice and any choices required by law.
You can delete your account anytime from your profile page. When you delete your account, your email is removed and your check-ins are anonymized - the link between your account and your submissions is permanently removed, but anonymous, de-identified, and aggregate experience data may be kept for statistics, security, service integrity, backups, and commercial insights.
To prevent abuse and keep Mood Swing available, we use recent submission activity, your anonymous session identifier, your account identifier if signed in, and your IP address to apply rate limits and protect the service.

By accessing or using Mood Swing, you agree to these Terms of Service. If you do not agree, do not use the service.
Mood Swing is a community-driven experience map. It lets people submit check-ins tied to location, vibe, sentiment, and related context so the service can show public, aggregate patterns about places and regions.
You must be at least 18 years old to use Mood Swing. The service is only intended for adults. Do not use the service if you are under 18 or if applicable law prohibits you from doing so.
Signing in uses email-based magic links. You are responsible for the email account you use, for keeping magic links private, and for activity connected to your account or browser session.
You are responsible for the check-ins, profile details, place lists, and other information you submit. Do not submit anything unlawful, harmful, misleading, private to someone else, or that you do not have the right to share.
You keep whatever ownership rights you have in your own submissions. By submitting content or information to Mood Swing, you give Mood Swing a non-exclusive, worldwide, royalty-free, sublicensable, transferable, salable license to host, store, copy, process, modify for formatting, display, publish, aggregate, anonymize, de-identify, analyze, and use your submissions to operate, protect, improve, promote, market, and sell the service.
Mood Swing may also create, commercialize, sell, license, transfer, and otherwise use aggregate, anonymized, de-identified, or demographic-derived outputs from your submissions without paying you or asking for additional permission. Those outputs may be used for marketing, sales, advertising about Mood Swing, business development, research, product demos, reports, datasets, and commercial insights.
Mood Swing does not claim ownership of your original submissions. We may use demographic characteristics, vibe patterns, location/place context, and other derived characteristics in aggregate, anonymized, or de-identified form. We will not use your name, email address, likeness, or account identity to imply your personal endorsement in public marketing materials without your permission, except as described in these Terms, the Privacy Policy, or as allowed by law.
The Privacy Policy explains how Mood Swing may use, disclose, sell, share, or transfer personal information, including for targeted advertising, audience enrichment, advertising measurement, data partnerships, and business transfers. These Terms do not limit any privacy choices that applicable law requires us to provide. Deleting your account does not require Mood Swing to remove aggregate, anonymized, de-identified, backup, security, or operational records that no longer identify you.
Mood Swing is not a medical, mental health, crisis, emergency, safety, navigation, weather, event, or professional advice service. It does not diagnose, treat, prevent, or monitor any condition. Do not rely on Mood Swing for emergencies or safety decisions. If you may be in danger or need urgent help, contact emergency services or a qualified professional.
Location, map, place, event, weather, recommendation, and aggregate vibe information may be incomplete, delayed, inaccurate, unavailable, or based on third-party sources and user submissions. You use this information at your own risk and remain responsible for your choices, travel, safety, and interactions with places or events.
Mood Swing, including its software, design, branding, text, graphics, compilations, databases, aggregate vibe data, maps, rankings, recommendations, and other service output, is protected by copyright, trademark, contract, and other laws. Except for the limited access the service intentionally provides through its normal user interface, you may not copy, reproduce, modify, publish, distribute, sell, license, mirror, frame, create derivative works from, or build a competing product or dataset from Mood Swing or its service data without written permission.
You may not use bots, crawlers, scrapers, harvesters, automated queries, scripts, browser automation, API reverse engineering, bulk downloads, account/session rotation, proxy rotation, or similar methods to access, collect, monitor, extract, index, train on, test against, or reuse Mood Swing content, user submissions, aggregate data, place data, event data, or service output. You may not bypass robots directives, authentication, rate limits, access controls, technical measures, or security controls. We reserve all rights and remedies, including blocking access, suspending accounts, seeking injunctive relief, damages, fees, and any other remedies available to the maximum extent permitted by law.
Mood Swing may change, suspend, limit, or discontinue any part of the service at any time. We may apply rate limits, moderation, security controls, or account restrictions to protect the service and other users.
Your use of Mood Swing is also governed by the Privacy Policy , which explains what data is collected and how it is used.
Mood Swing may rely on third-party services for email delivery, map data, event information, weather context, hosting, and other functionality. We are not responsible for third-party services, content, availability, policies, or practices.
Mood Swing and its software, design, branding, service content, compilations, aggregate outputs, analytics, and improvements are owned by Mood Swing or its licensors, except for user submissions and third-party materials. These Terms do not transfer ownership of the service to you. If you provide feedback, ideas, or suggestions, Mood Swing may use them without restriction or compensation.
Please read this section carefully. To the maximum extent permitted by law, you and Mood Swing agree that disputes, claims, or controversies arising out of or relating to the service or these Terms will be resolved by final and binding individual arbitration, not in court and not before a jury, except as stated below. The Federal Arbitration Act governs this arbitration agreement.
Before starting arbitration, the party with a dispute must provide the other party with written notice and give both sides 30 days to try to resolve the dispute informally. If the dispute is not resolved, arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, unless those rules are unavailable or another arbitration provider is required by law.
You and Mood Swing may bring claims only in an individual capacity. To the maximum extent permitted by law, you and Mood Swing waive the right to bring, join, or participate in any class action, collective action, representative action, private attorney general action, consolidated proceeding, or class-wide arbitration. The arbitrator may award relief only for the individual party seeking relief and only to the extent necessary to resolve that individual party's claim.
Either party may bring an individual claim in small claims court if it qualifies. Mood Swing may also seek injunctive or equitable relief in court to protect its intellectual property, confidential information, security, service availability, user privacy, or to stop scraping, automated access, misuse of service data, or unauthorized use of the service.
If a class action waiver or arbitration requirement is found unenforceable for a particular claim or request for relief, that claim or request must proceed in court only after all arbitrable claims are completed, unless applicable law requires otherwise. Coordinated or mass arbitration filings may be administered under the arbitration provider's mass arbitration procedures, including batching or staged proceedings, when available.
To the maximum extent permitted by law, Mood Swing is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. We do not guarantee that the service will be accurate, reliable, secure, uninterrupted, error-free, or fit for any particular purpose.
To the maximum extent permitted by law, Mood Swing and its owners, operators, contributors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost data, loss of goodwill, personal injury, emotional distress, or damages arising from your use of or inability to use the service. To the maximum extent permitted by law, total liability for any claim will not exceed the greater of the amount you paid to use Mood Swing in the 12 months before the claim or $100.
You agree to defend, indemnify, and hold harmless Mood Swing and its owners, operators, contributors, service providers, and affiliates from claims, losses, liabilities, damages, costs, and expenses arising from your use of the service, your submissions, your violation of these Terms, or your violation of law or another person's rights.
We may suspend or terminate access to Mood Swing at any time if we believe you violated these Terms, created risk, or used the service in a way that may harm Mood Swing, other users, or third parties.
We may update these Terms from time to time. Continued use of Mood Swing after updated Terms are posted means you accept the updated Terms.
Some laws do not allow certain disclaimers, liability limits, or exclusions. In those cases, these Terms apply only to the maximum extent permitted by law, and nothing in these Terms limits rights that cannot legally be waived.
You can opt out of the sale or sharing of your personal information for targeted advertising, audience enrichment, advertising measurement, and related data partnerships.
This choice applies to the current browser session if you are not signed in. If you are signed in, it applies to your account. You do not need an account to make this choice.
We use information submitted through Privacy Choices only to honor your privacy choices.
